Welcome to PatentFiller. These Terms of Service ("Terms") govern your use of the PatentFiller platform and services ("Service") operated by nextX AG ("Company", "we", "us", or "our"), a company registered in Switzerland.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

3. Description of Service

PatentFiller is a software platform that assists users in preparing USPTO-compliant provisional patent applications. The Service includes:

• AI-assisted patent document generation
• Patent quality review and analysis
• Prior art search functionality
• Document export in USPTO-compliant formats
• AI chat assistance for patent-related questions

4. Important Disclaimers

The Service is a document preparation tool only. We do not:

• Provide legal advice or patent prosecution services
• Guarantee the patentability of any invention
• Represent users before the USPTO or any patent office
• Review documents for legal sufficiency

Users are strongly advised to consult with a registered patent attorney or agent before filing any patent application.

5. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete registration information

6. Payments and Billing

Payment processing is handled by Lemon Squeezy, our Merchant of Record. By making a purchase, you also agree to Lemon Squeezy's terms of service.

6.1 Pricing

All prices are displayed in US Dollars (USD). Prices may change at any time, but changes will not affect orders already placed.

6.2 Subscriptions

Subscription plans renew automatically unless cancelled before the renewal date. You can cancel your subscription at any time from your account settings.

6.3 Taxes

Applicable taxes (VAT, sales tax) will be calculated and added at checkout based on your location.

7. Intellectual Property

7.1 Your Content

You retain all rights to your invention disclosures, patent drafts, and other content you create using our Service. We do not claim any ownership over your intellectual property.

7.2 Our Service

The PatentFiller platform, including its design, features, and underlying technology, is owned by nextX AG and protected by intellectual property laws.

8. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

8.1 Confidentiality

We understand that patent applications contain sensitive information. We implement industry-standard security measures to protect your data. However, no system is 100% secure.

8.2 Data Retention

• Free accounts: Data retained for 3 months after last activity
• Pro/Professional accounts: Data retained while subscription is active, plus 3 months after cancellation
• Paused accounts: Data retained for 6 months

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload malicious content or code
• Resell or redistribute the Service without authorization
• Use automated tools to scrape or extract data from the Service

10. Limitation of Liability

To the maximum extent permitted by law, nextX AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Patent application rejections or delays
• Errors or omissions in generated documents
• Interruptions to the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless nextX AG, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You may request export of your data within 30 days
• We may delete your data after the retention period

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Canton of Schwyz, Switzerland.
